Terms & Conditions

A Legal Disclaimer

These Terms and Conditions govern the purchase, download, access, and use of digital products sold by Zero44 ("Zero44", "we", "us", or "our").

For general inquiries or support, please use the contact information provided on our Contact page.

1. Digital Products

Zero44 sells digital products including, but not limited to, website templates, design templates, design assets, downloadable files, educational materials, courses, and other digital resources.

All products are supplied digitally unless explicitly stated otherwise. No physical product will be shipped.

Product descriptions will provide the main characteristics of each product and, where relevant, any known technical requirements, compatibility requirements, third-party software, or other services required to use the product.

2. Prices and Payment

Prices are displayed in the currency shown at checkout.

Applicable taxes, including VAT where required, will be calculated, displayed, or included in accordance with applicable law and the information presented during checkout.

Payment must be completed using one of the payment methods available at checkout.

An order is considered confirmed once payment has been successfully processed and an order confirmation has been issued.

3. Digital Delivery

Digital products are generally made available electronically following successful payment. Delivery may take place through a download link, customer account, email, online course platform, or another electronic delivery method.

You are responsible for ensuring that the information provided during checkout is accurate and that your device, software, and internet connection meet any compatibility requirements stated on the relevant product page.

If you experience a problem accessing a purchased product, please contact us through our Contact page.

4. EU and EEA Right of Withdrawal

If you are a consumer located in the European Union or European Economic Area, you may normally have a statutory right to withdraw from certain distance contracts within 14 days without giving a reason.

Different rules may apply to digital content that is supplied immediately.

Where you request access to digital content before the end of the applicable withdrawal period, Zero44 may ask you to expressly consent to the immediate supply of the digital content and acknowledge that you will lose your statutory right of withdrawal once supply of the digital content begins.

Where the requirements under applicable consumer law for the loss of the withdrawal right have been satisfied, you will no longer have the right to withdraw simply because you change your mind after supply has begun.

Nothing in this section limits your statutory rights where digital content is faulty, inaccessible, not as described, or otherwise fails to conform to the contract.

5. Refunds

Due to the digital nature of our products, purchases of digital content for which immediate supply has begun after valid consent and acknowledgement are generally non-refundable for change-of-mind requests, except where otherwise required by applicable law.

This policy does not limit any mandatory consumer rights.

If a digital product is faulty, corrupted, inaccessible, materially different from its description, or otherwise fails to conform to the contract, please contact us through our Contact page.

Where required by applicable law, Zero44 will provide an appropriate remedy. Depending on the circumstances, this may include correcting the product, providing replacement access or files, reducing the price, or issuing a refund.

6. Licence and Permitted Use

Unless different licence terms are provided with a specific product, purchasing a Zero44 digital product grants you a limited, non-exclusive, non-transferable licence to use the product for your own personal or professional projects.

Purchasing a product does not transfer ownership of the underlying intellectual property to you.

Where applicable, you may customise or modify templates and assets for your own permitted projects.

Unless expressly permitted by the applicable product licence, you may not:

Resell, redistribute, sublicense, share, or give away the original digital product.
Make the original product or its source files available for download or access by another person.
Claim the original Zero44 product, design, course, or content as your own creation.
Repackage or modify a Zero44 product for the primary purpose of reselling or redistributing it as a template, asset, resource, course, or competing digital product.
Share account credentials or course access with another person.
Reproduce or distribute course materials, videos, downloads, or educational content without permission.
Use Zero44 products in a way that violates applicable law or the rights of another person.

Additional licence terms displayed on an individual product page form part of these Terms.

7. Website Templates and Design Assets

Some Zero44 products may require third-party platforms, software, fonts, plugins, applications, hosting plans, subscriptions, or other services.

Unless explicitly stated otherwise, third-party products and services are not included with your purchase.

Zero44 does not control third-party platforms and cannot guarantee their continued availability, pricing, functionality, compatibility, policies, or future updates.

Where relevant, known material compatibility requirements will be disclosed in the applicable product description.

It is your responsibility to ensure that you have access to any required third-party software or services identified before purchase.

8. Courses and Educational Content

Zero44 courses, tutorials, guides, exercises, and other educational materials are provided for educational and informational purposes.

Individual results may vary depending on experience, circumstances, effort, implementation, and other factors.

Zero44 does not guarantee that purchasing or completing a course will result in a particular professional, financial, employment, business, design, or other outcome.

Course materials are protected by applicable intellectual property laws and may not be copied, recorded, reproduced, redistributed, resold, published, or made publicly available unless expressly permitted.

9. Intellectual Property

Unless otherwise stated, Zero44 or its licensors retain all intellectual property rights in Zero44 products and original content, including templates, designs, graphics, illustrations, written materials, videos, course materials, branding, website content, and downloadable resources.

Purchasing a product grants only the usage rights expressly provided under these Terms or the licence accompanying the applicable product.

All rights not expressly granted are reserved.

Zero44 names, branding, logos, graphics, and other proprietary materials may not be used in a way that suggests endorsement, partnership, or affiliation without permission.

10. User-Provided Content

Where a product or service allows you to provide or upload text, images, photographs, logos, graphics, or other materials, you are responsible for ensuring that you have the necessary rights and permissions to use those materials.

You retain ownership of your own original content.

You are responsible for ensuring that your use of third-party content complies with applicable copyright, trademark, privacy, and other laws.

11. Product Updates

Zero44 may occasionally update, improve, modify, or discontinue digital products where permitted by applicable law.

A purchase does not automatically include unlimited future versions, redesigns, new features, or additional content unless this is expressly stated on the applicable product page.

Where applicable law requires Zero44 to provide updates necessary to maintain the conformity, functionality, or security of digital content or a digital service, those updates will be provided as required by law.

Nothing in this section limits your statutory consumer rights.

12. Availability

We take reasonable measures to keep our website, downloads, courses, and digital products accessible.

Temporary interruptions may occur due to maintenance, hosting problems, technical issues, third-party services, software updates, or circumstances outside our reasonable control.

Zero44 does not guarantee uninterrupted availability of its website or third-party platforms.

Where purchased digital content cannot be supplied or accessed, your statutory rights and remedies remain unaffected.

13. Third-Party Services and Content

Zero44 products may contain or reference third-party websites, platforms, software, fonts, plugins, applications, stock assets, or other services.

Third-party products and services are subject to their own terms, licences, privacy policies, and usage restrictions.

You are responsible for reviewing and complying with applicable third-party terms.

Zero44 is not responsible for changes made by third-party providers, including changes to pricing, features, availability, compatibility, or licensing, except where responsibility cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Zero44 will not be liable for indirect, incidental, or consequential losses resulting from the use or inability to use our digital products where such liability may lawfully be excluded or limited.

You are responsible for determining whether a product is suitable for your intended use and for complying with applicable laws, regulations, platform requirements, licences, and professional requirements.

Zero44 does not guarantee that a template, asset, course, or other digital product will satisfy every individual business, technical, legal, accessibility, SEO, financial, or commercial requirement.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Nothing in these Terms excludes, restricts, or otherwise affects mandatory consumer rights available to you.

15. Privacy and Personal Data

Personal data collected through our website, checkout process, or services is handled in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR) where applicable.

Our Privacy Policy provides further information about how personal data is collected, used, stored, and protected.

16. Changes to These Terms

Zero44 may update these Terms from time to time to reflect changes to our products, services, business practices, or applicable legal requirements.

The Terms applicable to an individual purchase are generally those presented to you when the contract is concluded, subject to any mandatory provisions of applicable law.

Changes to these Terms will not retroactively remove statutory rights that applied to an existing purchase.

17. Governing Law and Consumer Rights

These Terms are governed by the laws applicable to Zero44's business operations, subject to mandatory provisions of applicable consumer law.

If you are a consumer residing in the European Union or European Economic Area, nothing in these Terms deprives you of mandatory consumer protections available under the laws applicable to you.

Where mandatory consumer law provides rights that conflict with any provision of these Terms, those mandatory rights will take precedence.

18. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law.

The remaining provisions will continue in effect to the fullest extent permitted by law.
